SUNLIFE
Systems offers a single source, non-prorated labor and material warranty
on full roof applications. This warranty guarantees that the customer
never has to be concerned with the "source" of a roof problem.
GENERAL COMMITMENT:
SUNLIFE Systems International, Inc. (Sunlife) hereby warrants
that the above-identified Roof area shall be by it maintained free of
leaks for a period of ten (10) years following completion of installation
of a SUNLIFE Roofing System over such roof area, subject
to the conditions set forth in this warranty. The warranty is intended
to and shall extend to and cover solely the cost of repairs to or replacement
of a SUNLIFE System installed at the above location made necessary
by reason of defective materials supplied by SUNLIFE, failure of
workmanship in installation thereof, or normal wear and tear. If the warranty
applies to a given area, SUNLIFE at its own expense will make all
necessary repairs to the roof surface resulting from failure of materials
or workmanship, and liability therefor shall not exceed the cost of installation
of a SUNLIFE System for the ten (10) years of the Warranty
period. SUNLIFE shall not be responsible nor liable for
damage to other roof components nor for consequential damages. NOTWITHSTANDING
ANYTHING TO THE CONTRARY, THE INSTALLER OR CONTRACTOR OF SUNLIFE ROOFING
SYSTEMS SHALL BE RESPONSIBLE FOR ALL ROOF LEAKS FOR A PERIOD OF TWO
(2) YEARS AFTER COMPLETION.
WHEN WARRANTY APPLIES:
The warranty is effective only for that portion of the above identified
premises which is a ãomplete unit in its entirety surfaced buy those
products constituting the integral parts of an installed SUNLIFE Roofing
System when installed by an authorized SUNLIFE contractor/applicator.
A complete unit is defined as the entire contiguous area existing between
defined parapet walls and/or expansion joints, if the expansion joints
delineate areas which in the substrates and other building components
are structurally independent units, and where the SUNLIFE System
is installed over same to and including flashings of all parapet walls/joints
established as the perimeter of such complete units.
The warranty does not apply to isolated or dispersed patch work or partial
areas constituting less than a complete unit, installed periodically as
repair and maintenance service; however, in such situations Sunlife warrants
there shall be no leaks penetrating the SUNLIFE System as installed.
The warranty does not extend to nor cover any underlying structural or
substrate defects in components of a roof nor damages thereto. Nor does
this warranty extend to nor cover any components such as metal work, expansion
joints, skylights, air conditioners, drains, scuppers, gutters, copings,
parapet walls, protrusions, or other areas except where coated/surfaced
with the SUNLIFE System in accord with customer job/purchase order.
And in no event shall the warranty be effective against occurrences or
any condition caused by negligence or any deliberate act to or resulting
in damage to the subject roof system or roof area on the part of companies
or persons other than SUNLIFE, its agents, or employees.
Because of settling and uneven roof surfaces, ponding of water may occur.
If ponding occurs and customer is notified and fails to correct the situation
by drains or other means, all warranties will be null and void.
OTHER CONDITIONS:
This warranty shall not take effect until all bills for installation,
supplies and service have been paid in full. It shall not be effective
unless the contracting party notifies SUNLIFE in writing (by certified
or registered mail) of any leaks within thirty (30) days of the time at
which such leaks are discovered. The warranty shall be null and void if
any of the following occur: (a) if, after installation, there are any
alterations or repairs made on or through the roof, or objects such as
but not limited to fixtures, equipment or structures are placed on or
attached to the roof without first obtaining written approval of SUNLIFE;
(b) if the occupant or owner of the premises fails to use reasonable care
in maintaining the roof; (c) if there is any significant change in the
use of the building by the occupant or owner thereby affecting the roofing
membrane as originally installed; (d) if SUNLIFE, its agents, and
employees are not granted free access to the roof during regular business
hours; or (e) if the contracting party, occupant, or owner fails to comply
with each and every term and condition of this warranty.
EXCLUSIVE WARRANTY: THIS WARRANTY IS EXCLUSIVE AND REPLACES ALL OTHER WARRANTIES
WHETHER EXPRESSED OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE OR USE. NO REPRESENTATIVE, EMPLOYEE OR
AGENT OF SUNLIFE OR ANY OTHER PERSON HAS AUTHORITY TO ASSUME FOR SUNLIFE ANY
ADDITIONAL LIABILITY OR RESPONSIBILITY IN CONNECTION WITH A SUNLIFE ROOFING
SYSTEM EXCEPT AS DESCRIBED ABOVE. IN NO EVENT SHALL SUNLIFE BE LIABLE FOR
INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, EXCEPT IN A STATE IN WHICH
SUCH DAMAGES CANNOT BY LAW BE EXCLUDED.
